Privacy & POPIA Notice

How NTSWAKAZA HOLDINGS (PTY) LTD handles personal information under the Protection of Personal Information Act, 4 of 2013 (POPIA).

1. Who we are

NTSWAKAZA HOLDINGS (PTY) LTD builds, develops and operates businesses and ventures across diverse industries, while offering a broad range of services that create practical value for our clients, partners and communities.

This notice applies to personal information processed by NTSWAKAZA HOLDINGS (PTY) LTD through this corporate website (ntswakazah.co.za) and through direct corporate correspondence with us. Individual ventures and products operated by the company may publish their own privacy notices, which apply to those services.

2. What personal information we collect

We keep collection to the minimum needed to respond to you:

  • Identity and contact details you choose to give us, such as your name, email address and organisation.
  • The content of your enquiry, including the subject and message you send us.
  • Correspondence records where you email us directly at our published address.
  • Basic technical information generated automatically when a browser requests a page, such as the request itself and standard server log data used to keep the site available and secure.

We do not ask for, and you should not send us, learner information, identity numbers, financial or payment details, health information or any other special personal information through this website.

3. Why we process it

  • To read, assess and respond to corporate enquiries.
  • To communicate with clients, partners, suppliers and other stakeholders.
  • To keep the website available, secure and functioning correctly.
  • To comply with legal and regulatory obligations that apply to us.

We rely on your consent, the performance or conclusion of a contract, our legitimate interests in operating and protecting our business, and compliance with the law, as applicable to each purpose.

4. The contact form on this website

The enquiry form on our Contact page does not store your details on this website and does not send them to a database. It prepares an email in your own email application, addressed to support@ntswakazah.co.za. The message is only sent once you send it, and it is then handled as ordinary business correspondence.

5. Sharing your information

We do not sell personal information. We may share it with service providers that support our operations, such as email and hosting providers, and with professional advisers, regulators or authorities where the law requires or permits it. Where information is processed outside South Africa, we take reasonable steps to ensure it receives a comparable level of protection.

6. How long we keep it

We keep personal information only for as long as it is needed for the purpose it was collected for, or for as long as the law requires us to retain it. Enquiry correspondence is retained for as long as it remains relevant to the relationship, after which it is deleted or de-identified.

7. Security

We apply reasonable technical and organisational measures to protect personal information against loss, unauthorised access, disclosure or destruction. No method of transmission over the internet is completely secure, so please do not send sensitive information to us by email.

8. Your rights as a data subject

Subject to POPIA, you may:

  • Ask what personal information we hold about you and request access to it.
  • Ask us to correct, update or delete personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained.
  • Object to processing that relies on our legitimate interests, in the circumstances allowed by POPIA.
  • Withdraw consent where processing is based on consent, without affecting processing already carried out.
  • Complain to the Information Regulator of South Africa.

9. Information Regulator

You have the right to lodge a complaint with the Information Regulator (South Africa) if you believe we have not handled your personal information lawfully. Details for the Regulator are published on the Regulator’s own official website.

10. Changes to this notice

We may update this notice from time to time. The revised version applies from the date it is published on this page, and the “last updated” date above will reflect the change.
